- Contract of Hire
The hiring contract will be between you the Hirer and Ruth Boswell (hereinafter called the Owner). The property for which the booking is made shall be deemed to be made subject to these Conditions of Hire and governed by English Law. The Contract of Hire is not effective until the Owner receives written confirmation of the booking and is in receipt of the booking deposit or full payment.
The contract is for the hire of the property for holiday purposes only and at no time can the maximum occupancy of six person be exceeded. We do not accept bookings from Hirers under 18 years of age.
The Beach House is cleaned and inspected between lets. On arrival please notify us of any defects within 24 hours; failing which you are deemed to accept the condition of the property.
By accepting our Terms and Booking conditions the client has agreed to leave the property at the end of their stay in the condition as found. In the unlikely event of the property not being left to the required standard the client will be notified in writing and the cost of extra cleaning/rectification/repair will be invoiced to the client and deducted from the booking deposit. The word of the owner/or their representative will be final in this respect.
Breakages and damages should either please be replaced by the Hirer with similar or advised to the Owner to enable this to be done at replacement cost to the Hirer.
The person making the booking will remain responsible for all members of the party and should ensure they are aware of booking conditions. If these are not met, the Owner could refuse right of entry to the property and no monies will be refunded.
- Making a booking
Please make your provisional holiday reservation with us by email. We will send you an invoice and you will be requested to pay a booking non-refundable deposit of £100 by return to secure the booking – if the start date is more than 8 weeks after the date of your provisional booking. If the booking is within 8 weeks of your holiday start date, full payment will be required at the time of booking.
In either case, your provisional booking can be held for no longer than 5 days for receipt of your payment, after which your provisional booking will lapse, unless an agreement has been made with the Owner.
Your booking is not confirmed until either your deposit or full payment has been received by us together with a signed booking form and your booking has been confirmed by email.
- Paying the balance of the holiday hire
Your balance of hire is due for payment, without demand, no later than 2 weeks prior to your arrival. Should your balance not be paid as above the owner reserves the right to cancel the booking without notice.
- Variations of price
We reserve the right to vary prices without notice. The price of your holiday is however guaranteed once a booking confirmation has been received by you.
- Included in hire
Your holiday hire includes use of the property from 4.00pm on the day of arrival as specified in your booking confirmation until 10.00am on the specified day of departure. Your hire includes heating, electricity, water, towels and linen for 6 people.
- Changes to your booking
After your booking has been confirmed, any changes will incur an administration cost of £20.00 to cover the cost of replacement paperwork. Changes within 8 weeks of the start date of your holiday may incur additional cancellation charges and all requested changes will be subject to availability.
- Cancellation of the booking by you
On confirmation of your booking, a contract of hire will exist between the Hirer and the Owner. In the event of cancellation by you 8 weeks or more before your holiday, your £100 booking deposit will be non-refundable.
Cancellation within 8 weeks of your holiday will forfeit the full hire amount paid (or due) unless the owners can re-let the property in which case only the £100 booking deposit will be forfeit to cover administration and re-letting costs.
- Cancellation of the booking by us
If, due to unforeseen circumstances, the property becomes unavailable for the dates hired by you due to unforeseen circumstances, all efforts will be made to offer suitable alternatives. If this is not possible, then all monies paid by you (the Hirer) will be refunded to you in full with no deductions but the Owner will incur no further liability of any kind. Under no circumstances will the Owner be liable to refund any amount exceeding the amount paid by the Hirer.
- Liability
The Owner accepts no liability whatsoever for any Loss, Damage, Injury or Accident to the Hirer or any member of the Hirer’s party or property whilst in occupation of the property or its grounds howsoever caused.
- Cancellation and Personal Insurance
It is very strongly recommended that you have adequate personal and holiday cancellation insurance to cover you and all members of your party. This should be suitable for UK self catering holidays arranged independently of a travel agent and should include cancellation protection cover to safeguard you against loss of the cost of your holiday in the event of unexpected cancellation.
Under no circumstances will the Owners be responsible for loss of life, personal injury, medical expenses, accidents, damage to the Hirers property, personal effects or motor vehicle(s) and you should ensure that any insurance covers such eventualities.
- Pets
Only 2 dogs, house trained, are permitted and at no time should the dogs be left alone in the property. The welfare and safety of the dogs remain the sole responsibility of the Hirer. All efforts must be made by the Hirer to ensure the dogs do not damage or soil the property and the contents. Additional charges may be made if the property is deemed to have damaged.
- Smoking and Naked Flames
For the comfort of all guests and in adherence to current legislation, smoking / vaping is not permitted anywhere inside the premises. Also, there is a strict ban on candles and placing clothing in front of the fire or on top of the radiators for drying purposes. Disposal barbecues, must be placed on the concrete paving area and be disposed of appropriately. Additional charges may be made if the property is deemed to have damaged by the use or disposal of the barbecue.
- Access Road
Mill Lane and Newlands Estate are unadopted roads, so are rougher than normal council adopted roads and are unlit. Both have a recommended speed limit of 5 mph. The roads are maintained by the residents, but if the weather has been very wet the road does suffer with potholes. The speed limit ensures sustainability to the road surface, safeguards your car from damage and also keeps the pedestrians and wildlife safe.
- Web Site & literature differences or omissions
Our web site and literature is intended as a guide to the property and facilities only, and we reserve the right to make changes to the facilities provided or to the property without prior notice. We regret we cannot accept any liability for errors, mistakes or omissions which may arise from any differences between the property or the facilities provided and our website or literature.
